These terms govern the booking of guided canyoning, via ferrata and other mountain activities, as well as the courses and services offered by Indartu Adventure.
Each activity will include a description of its location, date, approximate duration, level, requirements, price and included services. That information forms part of the booking terms.
Trips, expeditions and multi-day services may be subject to specific terms, which will be provided before booking. Where they apply, they will prevail over these general terms in the matters they specifically cover.
The person making the booking must be of legal age and have the capacity to enter into a contract.
If you book for other people, you must share the activity information and these terms with them and provide accurate details for each participant. You must also be authorised to provide their personal data.
A booking requires full payment of the stated price. Indartu Adventure does not take deposits or leave amounts to be paid on the day of the activity, unless another form of payment has been expressly agreed for a specific service.
The booking is confirmed once payment has been received and Indartu Adventure has sent the corresponding confirmation by email or by the agreed means.
An enquiry, a WhatsApp conversation or an availability request does not guarantee a place and is not a confirmed booking.
The customer must check the details in the confirmation and report any error as soon as possible. If Indartu Adventure cannot accept a booking due to an availability or pricing error, it will let the customer know and refund any amount charged in full.
Prices are stated in euros and include applicable taxes, unless expressly stated otherwise.
Before payment, the customer will be informed of the total price and of any additional charges that apply to the service booked.
Payment may be made using the methods available during the booking process. The customer may request an invoice by writing to info@indartuadventure.com and providing the necessary tax details.
Unless the description or specific proposal states otherwise, guided activities include the technical organisation, the necessary guide or guides, the technical equipment specified for the activity, and the applicable civil liability and accident insurance.
Photographs may be provided when the course of the activity and safety conditions allow them to be taken. A specific number of photographs is not guaranteed.
Unless expressly stated otherwise, the price does not include travel to the meeting point, accommodation, meals, drinks, footwear, personal clothing or any services not described as included.
The customer will bear the cost of transport, accommodation or other services they book independently.
Each participant must meet the minimum age and the physical or technical requirements stated for the activity. For water activities where this is required, participants must be able to swim.
Before taking part, participants must inform Indartu Adventure of any injury, illness, allergy, pregnancy, medication or circumstance that may affect their safety or that of the group. They must also give truthful information about their previous experience.
Participants must bring the personal equipment requested, follow the guide’s instructions, use the equipment correctly and respect the rest of the group, the environment and applicable regulations.
Participation will not be allowed under the influence of alcohol, drugs or other substances that reduce the abilities needed to carry out the activity safely.
Canyoning and mountain activities take place in a changing natural environment. They may involve risks such as falls, knocks, slips, rockfall, changes in water flow, flooding, hypothermia, fatigue, adverse weather or evacuation difficulties.
Participants acknowledge that they have received information about the nature and difficulty of the activity. The existence of risks inherent to the natural environment does not mean a waiver of their rights, nor does it exclude any liability that legally corresponds to Indartu Adventure.
The guide leads the activity and may adapt the route, change schedules, avoid certain manoeuvres, change the activity or suspend it when necessary for safety reasons.
The guide may also prevent or stop the participation of anyone who does not meet the requirements, has withheld relevant information, disobeys instructions or puts the group at risk.
If exclusion is due to dangerous behaviour, failure to follow instructions, or false or omitted information from the participant, no refund will be given.
Minors must meet the minimum age set for each activity and have authorisation from their legal guardians.
Indartu Adventure may request a signed authorisation, identity documents or the presence of a responsible adult when the characteristics of the activity so require.
The person booking for a minor guarantees that they are authorised to do so and to provide the minor’s data.
Cancellations must be made in writing to info@indartuadventure.com, stating the name of the person who made the booking, the activity and the date.
For one-day activities, notice periods are counted from the moment Indartu Adventure receives the request until the scheduled start time of the activity:
The new date must be used within 12 months of the originally booked date, and the date may only be changed once. Once that voluntary change is confirmed, cancelling the second date will not create a new right to a refund, without prejudice to the customer’s rights if Indartu Adventure cancels the activity.
The customer may propose that another person takes their place, provided they notify this before the activity and the substitute meets the requirements.
Illness, injury, transport problems, work reasons or other personal circumstances are subject to these same notice periods. Indartu Adventure may exceptionally consider other solutions, without this changing the general policy.
Participants must arrive on time at the stated place.
If a late arrival makes it impossible to maintain safety conditions, schedules or the normal running of the group, Indartu Adventure may start the activity without waiting for those who are late. In that case, the no-show terms will apply.
Rain or an unfavourable weather forecast does not by itself mean cancellation. Indartu Adventure will assess the actual conditions, including weather, water flow, access, alerts, environmental regulations and the group’s ability.
When an activity cannot be carried out safely, Indartu Adventure may offer a change of time, route, activity or date.
If Indartu Adventure definitively cancels the service booked and the customer does not accept an alternative, it will refund 100% of the amount paid for that service.
Transport, accommodation or other services booked directly by the customer are not part of that refund, unless legally required or booked as part of the same service.
Where a refund applies, it will be made using the same payment method, unless otherwise agreed.
Indartu Adventure will process the refund without undue delay and, at the latest, within 14 calendar days of confirming that it applies.
Leisure activities booked for a specific date or period are exempt from the general 14-day right of withdrawal that applies to certain distance contracts.
Therefore, booking an activity with a specific date online does not give the right to cancel it free of charge within 14 days of purchase. The cancellation periods in section 12 apply.
If a service is offered to which this exception does not apply, Indartu Adventure will provide its withdrawal terms before booking.
Participants must use the equipment provided according to the guide’s instructions and return it at the end.
They will be liable for damage caused intentionally or through use clearly contrary to those instructions. They will not be liable for normal wear and tear resulting from correct use.
Promotional publication of photos or videos in which a participant can be identified requires their separate and optional consent.
Refusing publication will not affect the booking or participation. Consent may be withdrawn by writing to info@indartuadventure.com, without affecting uses lawfully made before withdrawal.
Participants must respect the privacy and image rights of the other people in the group.
Indartu Adventure holds the insurance required for the activities it provides. Coverage, limits and exclusions are those set out in the corresponding policies.
Any accident or incident must be reported to the guide immediately so that assistance can be given and, where appropriate, the insurance claim can be processed.
Certain trips or activities outside the usual area may require specific insurance; this will be indicated before booking.
Trips, expeditions, multi-day courses and tailor-made services may have specific terms on included services, payments, minimum number of participants, changes and cancellations.
These terms will be provided before booking. The cancellation policy in section 12 applies to one-day activities and will not automatically extend to these other services.
Where a product legally qualifies as a package travel or linked travel arrangement, the rights and obligations provided for that type of contract will apply.
